The U.S. Trade Representative (USTR) recently published a notice in the Federal Register granting the extension of the existing China Section 301 Exclusions including the 352 previously reinstated exclusions and the 77 COVID-related exclusions. These exclusions have been extended to June 14, 2024. Additionally, the notice further extends certain product-specific exclusions to May 31, 2025.
In the Federal Register notice, the USTR provides the specific products that will be extended through May 31, 2025:
- There will be a new HTS# (9903.88.69) for the exclusions that are in effect from June 15, 2024 through May 31, 2025.
- Only 164 of the existing 429 exclusion have been extended. The specific products are provided in Annex C of the notice.
Products that were not extended past June 14, 2024 will subject to the applicable Section 301 tariffs (25% for Lists 1, 2 and 3, and 7.5% for list 4) for entries on or after June 15, 2024.
